Terms of Service

1. General

1.1. These Terms govern the use of the Crushgram mobile application and service (the “Service”). By installing, opening or using the Service, you fully and unconditionally accept these Terms. If you do not agree, do not use the Service.

1.2. The Administration may change the Terms at any time without individual notice. Continued use of the Service means acceptance of the amended version.

2. Eligibility

2.1. The Service may be used only by persons who are at least 18 years old and have full legal capacity. By registering, you confirm that you are at least 18.

2.2. You undertake to provide accurate data and are solely responsible for keeping it up to date.

3. Account and Security

3.1. You are responsible for keeping access to your account secure and for all actions performed under it.

3.2. The Administration may suspend or delete an account for a breach of the Terms, as well as on other grounds at its discretion, without explanation and without compensation.

4. User Content

4.1. You retain the rights to the content you upload (photos, texts, etc.), but grant the Administration a free, non-exclusive, worldwide licence to store, reproduce, adapt and display it for the purpose of operating the Service.

4.2. You warrant that you hold all rights to the content you publish and that it does not infringe the rights of third parties or the law.

4.3. It is prohibited to post unlawful, offensive, pornographic, misleading or discriminatory content, spam, or any content involving minors.

5. Rules of Conduct

5.1. The following are prohibited: harassment, threats, fraud, collecting other people’s data, circumventing technical restrictions, commercial activity without the Administration’s consent, and using the Service for unlawful purposes.

5.2. The Administration may (but is not obliged to) moderate content and review complaints at its discretion.

6. Dating and Interaction Between Users

6.1. The Service merely provides the technical means to meet people. The Administration does NOT verify users, does not run background checks, and does not guarantee the identity, intentions, safety or good faith of other users.

6.2. You engage in any communication and meetings at your own risk. You assume all risks associated with interacting with other users.

7. Disclaimer of Warranties

7.1. The Service is provided “AS IS” and “AS AVAILABLE”, without any warranties, express or implied, including warranties of fitness for a particular purpose, uninterrupted operation, error-free performance and security.

8. Limitation of Liability

8.1. To the maximum extent permitted by law, the Administration is not liable for any direct, indirect, incidental or other damages, lost profits, or harm to life, health or property arising in connection with the use of or inability to use the Service, the actions of other users or third parties.

8.2. The Administration’s aggregate liability, if any is nonetheless established, is limited to the amount you actually paid for the Service over the last 12 months (or zero if there were no payments).

9. Indemnification

9.1. You undertake to reimburse the Administration for any losses and expenses (including legal ones) arising from your breach of the Terms or the rights of third parties.

10. Intellectual Property

10.1. All rights to the Service, its design, code and trademarks belong to the Administration. Any use without permission is prohibited.

11. Termination

11.1. You may stop using the Service at any time by deleting your account. The Administration may cease providing the Service in whole or in part at any time.

12. Governing Law and Disputes

12.1. The Terms are governed by the law of the Administration’s location (to be specified). Disputes are resolved in the competent court at the Administration’s location, unless otherwise required by mandatory rules.

13. Miscellaneous

13.1. The invalidity of any single provision does not affect the validity of the rest.
